These Terms of Service ("Terms") are a binding agreement between you and Cognfy LLC ("we," "us," "our") governing your use of the Snapchamps app and related services (the "App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. The service

Snapchamps is a game in which you photograph everyday objects and an AI image model generates a stylized creature character from each photo. You collect, raise, and battle these creatures. Creatures are generated by machine-learning models and may vary in quality, accuracy, and uniqueness.

2. Eligibility

You must be at least 13 years old to use the App. By using the App you represent that you meet this requirement. The App is not intended for children under 13.

3. Your content and the rights you grant

"Your Content" means the photos you submit and the creatures generated from them. You retain ownership of your photos. You represent and warrant that you have the right to photograph and submit Your Content, and that Your Content and its use in the App do not violate any law or any third party's rights (including privacy, publicity, copyright, or trademark rights). You grant us a worldwide, non-exclusive license to host, process, reproduce, and display Your Content as needed to operate the App, including showing your generated creatures to other players during battles and on shareable cards you create.

4. Acceptable use and zero tolerance for objectionable content

We have zero tolerance for objectionable content and abusive behavior. You agree that you will not submit, generate, or share content that:

• is sexually explicit, pornographic, or depicts nudity;
• sexualizes, exploits, or endangers minors in any way (this is strictly prohibited and reported to authorities);
• depicts, sexualizes, harasses, or impersonates a real person without their consent, including intimate images;
• is hateful, harassing, threatening, or promotes violence or self-harm;
• infringes any third party's intellectual property, including reproducing brand logos, trademarks, or copyrighted characters; or
• photographs an identifiable person without their consent.

You also agree not to abuse, harass, or threaten other users, and not to attempt to cheat, reverse engineer, or disrupt the App.

5. Moderation, reporting, and enforcement

We use automated tools to screen submitted photos and generated creatures, and we may remove content or suspend or terminate accounts that violate these Terms. We aim to act on reports of objectionable content within 24 hours.

• Child safety: apparent child sexual abuse material is reported to the National Center for Missing & Exploited Children (NCMEC) as required by law.
• Nonconsensual intimate imagery: if you are depicted in an intimate image shared without your consent (including AI-generated imagery), contact us and we will remove valid requests within 48 hours.

6. Intellectual property notices (DMCA)

If you believe content in the App infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to [email protected]. We respond to valid notices and terminate repeat infringers.

7. Purchases

The App may offer in-app purchases processed by Apple. All sales are final except as required by Apple's policies or applicable law. Purchases are tied to your account and platform.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that AI-generated content will be accurate, unique, non-infringing, or free of error, or that the App will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Cognfy LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

10. Indemnification

You agree to indemnify and hold harmless Cognfy LLC from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content or your violation of these Terms or of any law or third-party right.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the App or its users.

12. Governing law

These Terms are governed by the laws of the United States and the state in which Cognfy LLC is organized, without regard to conflict-of-laws rules.

13. Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, noted in the App. Continued use after changes means you accept the updated Terms.
